NEW YORK, NY; SEPTEMBER 25, 2007: - As part of an ongoing effort to prove the innocence of one Dr. Malachi Z. York, Consul General Diplomat D/P #003828-04 of the Republic of Liberia, West Africa Citizenship #108208, misnomer Dwight York (Inmate #17911-054), and stop the defamation of our Nuwaubian way of life we are sending out a Public Outcry to speak on the true nature of the lies being told against Dr. York and the Nuwaubians. CBS Paramount Television’s (CBS) syndicated show The Montel Williams Show is scheduled to air on Tuesday, September 25, 2007, a program entitled “Exclusive: Cult Survivor’s Speak Out” and is expected to attract hundreds of thousands of viewers by telling horrific lies told by disgruntled ex-members of the Nuwaubian community. The Nuwaubians, in conjunction with Dr. Malachi Z. York, are in the process of filing a temporary injunction against CBS, as Dr. York continues to pursue all legal remedies available to him. The tens of thousands of real members of this Nuwaubian community are requesting to be allowed access to the same audience in the same forum, for their voices to be heard.
Conspiracy against Dr. York by several of the alleged witnesses has existed for the past five years and continues to create negative publicity, providing a stage within this country for Constitutional violations of the right to a fair trial. The first and foremost is the conspiracy by the agents of the federal government to hide Malachi Z. York under his son’s name and the identity of Dwight (Totten) York, in their effort to elude Dr. York’s international status. CBS and The Montel Williams Show has created a biased, one-side story of Malachi Z. York that projects and amplifies the false allegations against Dr. York as truths, resulting in irreparable injuries for which they have no plan, speedy or adequate remedy at law. Both CBS and The Montel Williams Show have failed in conducting due diligence as to the truthfulness of the statements to be presented. In addition, CBS and The Montel Williams Show have failed to give accurate information on behalf of Malachi Z. York, in protection of his First Amendment rights. Unless Malachi Z. York and the Nuwaubians are justly heard, CBS and The Montel Williams Show only serve to perpetuate the mendacious words and slanderous statements as facts, thus, giving a voice to three disgruntled women who speak out of vindictiveness. Dr. Malachi Z. York and Nuwaubians will continue to live in an unnecessarily restrictive setting and suffer harm to their personal autonomy and freedom. The airing of this episode is a direct violation of their domestic and international rights.
In closing, CBS and The Montell Williams Show should postpone the airing of the show until either all legal remedies have been exhausted by Dr. York’s legal team or by allowing the Nuwaubians to also present their side of the story. There are always three sides to every story: his side, her side and the truth. The Nuwaubians are tired of having a mockery made of their way of life and want to let the “TRUTH BE TOLD.”
A BRIEF SYNOPSIS ABOUT THE YORK CASE AND NUWAUBIANS
Dr. Malachi Z. York is the original, but “retired” founder, teacher and guide of the Nuwaubians, whose beliefs stem from Ancient Africa now called Ancient Egypt. He is the author of almost 500 books related to science, religion and history and the most profound “The Holy Tablets.” Dr. Malachi Z. York, with numerous facts and evidence provided for his innocence, has been falsely accused and wrongfully arrested and detained for over the past five years. He was transferred 11 different times from various detention centers to three different maximum facilities. He is currently being held in Florence, Colorado (Super-max). Dr. York has been sentenced to 135 years in prison, despite the fact that the legal maximum sentence for same crime is 15 years and the numerous recanted statements made by many who originally testified against him. This sentencing occurred despite the fact that new evidence had come forth in the form of a videotaped statement of the key witness for the government, in which the key witness states that this was a conspiracy brought on by the disgruntled members of the Nuwaubian organization, under the coercion and threats of law enforcement officials.
Dr. Malachi Z. York and several members of his congregation were arrested on May 8, 2002, in the aftermath of a joint invasion by over 400 federal and state law enforcements officers, on the 476 acres of land owned by Dr. York’s congregation, also known as Tama-Re. This excessive use of force by federal and state government under the disguise of serving a search warrant was unprecedented and without probable cause, in light of the fact that Dr. York and his congregation had no known or reported history of violence or ever advocating violence in the State of Georgia or elsewhere.
The Nuwaubian community has undergone great trials and tribulations as a result of the questionable arrest, trial, and conviction of Dr. Malachi Z. York; in addition, to the unjust removal of his community from its 476 acres of land, which was subsequently given to the U.S. government, as a result of Mann Act and RICO convictions.
The Racketeer, Influenced, Corrupt, Organization Act (RICO Act) was enacted by Congress around 1970, to give a death kneel to the Mafia. Federal prosecutors have over zealously and systematically undermined the intent of Congress, by the misapplication of the RICO Act to depict Black spiritual leadership as Mafia dons, and their congregations as organized crime enterprises. These apparent misuses of the law resulted in long prison terms for that leadership, taking of property, and draining the congregation of all assets, which effectively destroyed the congregation. Dr. York and his congregation had no known or reported history of organized or unorganized criminal activities in the State of Georgia or elsewhere.
During the five-year legal ordeal of Dr. York and his congregation, the federal and state government under the "Dual Sovereignty Doctrine,” conducted a joint prosecution of Dr. York on a federal and state child molestation indictment. Dr. York, under duress and the great weight of ineffective assistance of counsel, bias negative media, probable improper federal and state prosecutable and judicial misconduct, and internal and external sabotage, entered into a plea agreement on January 23-24, 2003, in both federal and state courts. A federal judge later rejected Dr. York’s federal plea, deciding that Dr. York should have received a longer sentence than what was agreed upon by federal prosecutors and Dr. York’s attorneys. Dr. York’s attorneys made no effort to defend him from the Dual Sovereignty Doctrine, in effect waiving Dr. York’s rights against dual prosecution, which allowed both federal and state governments to simultaneously prosecute Dr. York at the same time. This move against Dr. York by federal and state government was unprecedented, in light of the fact that several similarly charged catholic priests had no intervention and prosecution applied to them by the federal government. This apparent "tag team" effort by federal and state government against Dr. York, destroyed his "Presumption of Innocence", and left Dr. York in a "Double Jeopardy" straight jacket. This is a Public Outcry.
